1. General

 

Our last Newsletter (No 13) was published in June 1984. Mr. Godbole had been away in the Falkland Islands in the South Atlantic Ocean. He is now working in London once again and. we therefore hope to be able to publish our Newsletters regularly.

 

2. News and. Current Events.

 

2.1 Veer Savarkar Birth Centenary

 

2.1.1 Due to the efforts of M/S Godbole, Sonpatki and Pendse (former Master of London Borough of Brent) a blue plaque has been placed by the Greater London Council on 65 Cromwell Avenue, Highgate, London N6. This is the house where Veer Savarkar used to live during 1906-1910. It is here that he wrote the Biography of Mazzini( Proscribed in India by British after the first edition.), History of the  Sikhs(presumed lost  in post,  but  most  probably confiscated by the British Authorities) and the world famous Indian War of Independence 1857. It was here that the Indian Revolutionary Association (Abhinav Bharat) was founded and it was decided to kill Curzon, the most arrogant and tyrant Viceroy of India. The attempt failed as the doors of the meeting were shut just few minutes before. Curzon-Wyllie, special adviser to Secretary of State for India was later shot dead by Madanlal Dhingra.

The blue plaque was unveiled by Lord Brockway on 8 June 1985. We request you to visit this house yourself and show it to visitors from India. It is such sites that we should search and visit for inspiration.

2.1.3 Importance of English_

 

Savarkar was released from internment in 1937. He was elected. President of Maharashtra Literary Conference and. speaking in that capacity on 15th April 1938 he said, "There is intense hatred, and dismal ignorance about the Marathas among European Historians and non-Maharashtrians  I therefore sincerely hope that Mr. Sardesai would undertake the vital task of writing in English, the History of Marathas. (This Mr. Sardesai achieved in 1946)

------  There are superb works in Marathi on various subjects but they will not be given due recognition unless translated in English. Once Sanskrit and Pali were World languages. Now English has taken their place. It is therefore essential that all Maharashtrians should come together and ensure that every year some important works are translated from Marathi into English......."

 

Nearly fifty years have now passed. What progress has been made? NONE. Savarkar's entire works (lectures, articles, poems, letters etc.) were published by Hindu Mahasabha in 1965. But publishing it in English? Good heavens, No. Admitted, it would be a costly undertaking but what about Savarkar’s letters from London? They are shrewd observations about the English. Even after 75 years this valuable information is available in Marathi only. Savarkar’s autobiography describing early years of his life (up to 1909) is still in Marathi only, Dhanarjay Keer's biography of Savarkar (in English) became out of print nearly 12 years ago. Any chance of it being reprinted? No. But we have one more Biography of Savarkar in Marathi by Mr.V.S.Valimbe! (Majestic Publication Feb 1986)

 

Maharashtra State Government had set up a committee under the Chairmanship of Laxmanshastri Joshi, a learned Scholar in around 1964.(Maharashtra State literature and culture Committee), with what purpose? Translating Marathi works into English? No, No, No, for translating English, Portuguese, Dutch, Persian, Rajastani (and other languages) works into Marathi. And thus Justice Ranade's - Rise of Maratha Power, Dr. Apte's "A History of Maratha Navy and Merchant ships and other English works have been translated, into Marathi!!

 

What a state of affairs.

 

3. How History gets falsified even today

During the Savarkar centenary year (1983-84) a well wisher from Madras who wanted to remain anonymous published a small booklet (7 pages) on Savarkar for free distribution to school children. Balarao Savarkar sent us few copies. The "bulletin contains some very serious blunders.

 

(1) Savarkar's biography of Mazzini was not banned before publication. The first edition was sold out like a hot cake. The book was proscribed before second edition could be published.

 

(2) The author states on page 3 " His (Savarkar's) health eventually deteriorated and the Government was compelled to transfer him to Indian prisons in 1921." This is utterly false. In Andaman no medical aid was ever given to political prisoners. British Authorities were absolutely callous in this respect. Savarkar's elder brother Babarao suffered terribly. Savarkar brothers were sent back to mainland India not because of failing health but because Government had decided to close down the prison settlement in Andaman, after several years of mounting public pressure in India.

 

(3) on page 1 the author says "..... In 1898 his inspirer and the noted revolutionary Chaphekar was hanged. This enraged young Vinayak who took a vow to struggle for freedom....." Facts are different. During the plague outbreak of 1897 people of Maharashtra were subject to indescribable insults abuses and humiliations by the British. No amounts of requests, pleas and petitions had any effects on their arrogant, tyrannical behaviour. Chaphekar brothers shot dead two British officers Rand and Ayhurst and immediately the British became civilised. When Chaphekar brothers were hanged Savarkar brothers vowed in front of Goddess Durga to fight to the last drop of their blood to overthrow the British Raj, not because Chaphekars were hanged but because they realised that the British do not give a damn to petitions but do understand the bullets.

 

 

4. Works of our friends.

 

Dr. V.S. Vakankar is Professor of Archaeology, Vikram University, Ujjain, India. He too agreed that Indian History must be revised. Here are some of his Findings.

 

4.1. The Aryans

 

The concept of origin of Aryans in central Asia, their migration and. Conquest of India, were all indentations of politically motivated. British scholars. It started- at the meeting of the Royal Asiatic Society of London on 9 April 1866.

 

Yet another mischief was played by Christian Missionaries. They declared that Aryans and. Dravidians were racially separate and that Dravidian languages were a distinct group. The perpetrators were Father Belchi, Rev. G.V.Pope, Father Henry Heras and others. Let us think a little. Throughout the Vedas the word Arya does not signify a caste or group (jati) not even once. The famous Hindu Deities are Ram and Krishna. Both are dark in complexion. Ram is called Savla Ram, Krishna is called Ghanashyam (dark like a cloud). Is anybody saying that Ram and Krishna were not Aryans?

 

If Aryans came to India from Central Asia they would first describe Kubha (Kabul) river, followed by Sindhu, Chinab, Sutlaj, Ravi, Beas, Saraswati, Yamuna, and lastly Ganges. But in the Vedic literature the sequence is exactly opposite.

 

4.2. Mohenjadaro and Harappa.

It is nonsense to say that these civilisations were destroyed by invading Aryans.. Rig-Veda contains details of Dashradnya War. Harappa was called Harayupiya.  There were 40 Kings on one side and 3 Kings on the other. Harappa was destroyed in this war. King of Harappa was named Chayman.

 

4.3. Porus and Alexander.

I do not think that any Greek Historians say that Porus was defeated by Alexander. We only read what has been written in English. After all how many of us have studied Greek? We don't have first hand knowledge of what has been written in Greek Language.

 

There are some coins with one King on Elephant. (Said to be Porus) and another King on Horse (said to be Alexander). The funny thing is that NOT one such coin has been found in India. In 1965 I went to Greece and went through coin catalogue of Bactrian Greece and realised that such coins have been found in Iran and Iraq but NOT in India.

 

 

 

4.4. Portuguese and India

When I visited Spain I had the opportunity to see the diary of Vasco-de-Gama. He says that when he reached Zanzibar (East Africa) he saw an Indian ship three times as big as his own. It belonged to a Gujarati merchant named Skanda. He used to bring timber and spices from India and exchange them for diamonds in Africa.

He used to trade in Cochin and used to sell diamonds to King Naykar. Vasco-de-Gama talked to Skanda through an African interpreter and was told to follow Skanda's ship to Cochin. (That's how Vasco-de-Gama reached India not on his own. This shows that even in 1498 Hindus were Sea-farers. The distance between Cochin and Zanzibar is 2800 Miles. But this truth is never told in our History books)

 

4.5 Indian War of Independence 1857.

We now know that this was not limited to few areas of North India. There were uprisings against the British in Karnataka, in Tamilnadu and in many other places. Full history of this Great War has not yet been written.

 

 

4.6. Muslim defeats.

 

Too much emphasis has been placed so far on. Muslim Chronicles. We must now use Hindu sources.

 

Tabkat-E-Nasiri describes Mahmud of Ghazni's incursions in India. The writer says that while returning from his last attack on Sorti Somnath, Mahmud was attacked by King Parmardi of South of Abu mountain. But what was the result? He does not say. How could he? Raja Bhoj of Dhar attacked Mahmud of Ghazani and he barely escaped with his life. But nobody mentions this fact. Near Vidisha there is a Udaypur Temple. It contains inscriptions on two windows called Udaypur Prashatis  some lines read--

Tah krodhatur varishaiva sahasa mlechhadhipandurdharah

 

King Bhoj trampled the Muslim king under the feet of his horses.

Udaypur second. Prashasti reads-

Chedishwarendra ratha toggalbheema mukhyan

Karnat latpati Gurjararat turushkan

 

"Kodand Kav^ra" by Bhoj contains following line;

Tabhi rakhi aa turukka dharani anjabaje sumatte

 

Remains of an inscription in Ujjain mentions celebrations of the victory of Raja Bhoj over Turuskas

… Bhojadeva kushalee…..

Turushka vijaya parvanee snatva ……

Bhanipati maha …….

Vatabhra ……..

 

Late Hariramchandra Divekar gives some important information. He says "Since then I have been in search for Davila Bhashya . Though unsuccessful in its quest my attempt became fruitful about Keshav Paddati...... As noted. before Darila is quoted by Keshava who is contemporary with King Bhoja of Malwa for whom he practiced, some Abhich-arakarma in order to help the King to kill his adversary - a Turushka i.e. Turk by name Mahamuda."

(Note- We agree. There are references in Epigraphia Indica giving details of defeats of Muslims. Even Nehru admits disastrous defeat and flight of Mahmud of Gazni after his last attack on Sorti Somnath. See Discovery of India 1974 edition p.235)

 

4.7. History of Bengal

We are told that with just few soldiers Bakhtiyar Khiiji conquered Bengal at a stroke. But various copper plates, donation papers, memorials of Satis tell us of a long and tough Hindu struggle with Muslims.

 

4.8 Hindu civilisation world wide:-

In 1963 I visited Egypt. In a museum I was surprised to see a small stone inscription in Brahmi script. The museum authority had put a note underneath -" Script unknown, un-deciphered." The director told me that the stone was discovered in 1860 during some archaeological excavations in Port Pusa in the Red Sea. After this episode, in 1964 I presented a paper entitled- " Brahmi inscriptions outside India” at the Oriental Congress held in Delhi. At that time I met one lady named Devahuti. She told me that in Indonesia, Germans, Japanese, Americans and even Russians are busy in Archaeological excavations. They are publishing details of stone inscriptions and their findings. It is our misfortune that not one Indian University has a chair of Indonesian studies.

 

The world abounds in remains of once prevalent Hindu civilisation. There is dearth of scholars to explore this past. But who would carry out archaeological excavations in Egypt and the Middle East and explore India's connections with these countries? Who is going to search the remains of Hindu civilisation; in Northern Australia?

5. Research Findings.

 

5.1 The Holy Bible

During his stay in Falkland. Islands Mr Godbole read the Bible with curiosity. Here are some of remarks on King James's bible.

 

5.1.1 Bigotry

At the bottom of the first page we find - "........ to the honour of that great GOD, and. the good of his church, through Jesus Christ our Lord and ONLY SAVIOUR."

(Last Line)

 

We have no objection to someone calling Jesus Christ as their Lord. But to say that he is the ONLY SAVIOUR breeds bigotry.

 

5.1.2 Adam, not the first man / Eve, not the first woman.

 

Genesis chapter 1 para 26 /27

 

And God said "let us make man in our image, after our likeness …….. So God created man in his own image, in the image of God he created him, male and

female created, he them.

 

para 28 And God blessed them and God said unto them, " Be fruitful and multiply and replenish the earth and subdue it ...."

 

And yet in chapter 2 we find- :

 

para 5

and there was not a man to till the ground. .

 

para 7

And the LORD GOD formed man of the dust the ground and breathed, into his nostrils the breath of life, and man became a living soul.

 

para 15

And the LORD.GOD took man and. put him into the garden of Eden to dress it and to keep it

 

para 16

And. the LORD GOD commanded, the man, saying, of very tree of the

garden thou mayest freely eat.

 

para 18

And LORD GOD said- it is not good that the man should be alone; I will 

make him and help meet for him.

 

 

But God had already created male and female!

 

Adam does not appear till para 19. And in para 21 we are told - and. The LORD GOD caused a deep sleep to fall upon Adam, and he slept; and he took one of his ribs, and closed up the flesh instead thereof .

 

para 22

And the rib, which the LORD GOD had taken from man, made he a woman, and brought her unto a man.

 

para 23

And Adam said "This is now "bone of my bones, and flesh of my flesh: She shall be called "woman "because she was taken out of man.

 

 

The name Eve does not appear till chapter 3 para 20.

 

 

5.1.3. When was the world created?

 

From various lists of Kings, James Ussher (1581 - 1656) Bishop of Cork (Ireland) worked out that the world was created in 4004 B.C. In 1899 Two-version edition of the Holy Bible of C.J.Glouscester was published by Oxford University Press, London. In the columns in the middle of the pages the author gives approximate dates of various events, starting from the creation of the world in 4004 B.C.

- St. Mathews Chapter 1 para 17 states : so all the generations from Abraham to David are 14 generations and from David until the carrying away into Babylon are 14 generations and from carrying away into Babylon unto Christ are 14 generations. The details of generations from Adam to Abraham are given in the first book of the chronicles Chapter 1, para 1 to 27. From all the above information, it may have been concluded that Adam was born in 4004 B.C. But we have already seen that Adam was not the first man. And therefore the World was NOT created in 4004 B.C.

 

5.1.4. Lord God of Israel

 

There are obviously many references to God in the Bible, but he is Lord God of Israel, NOT God of all mankind. Here are some extracts:

 

— Exodus- Chapter 5 Para 1

     And afterward Moses and Aaron vent in and told Pharaoh. Thus saith Lord

     God of Israel, let my people go- - - -.

 

 — Judges chapter 11

      para 21 - And the Lord God of Israel delivered Sihon and all his people into the

      hand of Israel........

      para 23 - So now the Lord God of Israel has dispossessed the Amorites.......

Chapter 1 para 30

     Even as I sware unto thee by the Lord God of Israel .....

Chapter 18

    para 5 He trusted in the Lord God of Israel.

 

Chapter 22

para 15. And she said unto them; Thus saith the Lord God of Israel.

para 18 .... Thus saith the Lord God of Israel. As touching the words which thou has

para 4. Howbeit the Lord God of Israel chose me before all the house of my father to    

            be king of Israel.

para 12. Huram said moreover Blessed be the Lord God of Israel.

 

Chapter 6.

para 4  And he said, blessed be the Lord God of Israel. .....

 

para 7 Now it was in the heart of David my father to build a house for the name of the Lord God of Israel.

 

para 10. ..... for the name of the Lord God of Israel.

 

para 14. And said O Lord God of Israel.

 

para 16. How therefore O Lord God of Israel keep with thy servant David.....

para 17. Now then  O Lord God of Israel let thy word be verified.

 

Ezra Chapter 6.

 

para 21 And the children of Israel ....... to seek the Lord God of Israel did eat

 

para 22. And kept the feast of unleavened bread ..... to strengthen their hands in the    

              work of the house of God, the God of Israel.

 

 Chapter 7

 

para 6. This Ezra went up from Babylon; and he was a ready scribe in the law of Moses, which the Lord God of Israel had given.....

 

para 15..... and his councillors have freely offered unto the God of Israel.

 

Chapter 9

 

para 15 O Lord God of Israel, thou art rightous for we remain yet escaped...

 

Isaiah Chapter 21

 

para 10 . ......I have heard of Lord of hosts, the God of Israel, have I declared unto you.

 

para 17.... for the Lord God of Israel hath spoken it.

 

Chapter 24

 

para 15  Wherefore glorify ye the Lord in the fires even the name of the Lord God of Israel in the isles of the sea.

 

 

Isaiah Chapter 24

 

para   23..... and sanctify the Holy one of Jacob and. shall fear the God of Israel

 

There-are many such references in the Jeremiah

 

         Chapter 31 para 23

         Chapter 32 paras 14, 15, 36.

         Chapter 33 para 4

         Chapter 43 para 10

         Chapter 44 paras 2, 7, 11, 25.

         Chapter 45 para 2.

         Chapter 46 para 25.

 

Zephariah Chapter 2 para 9

Therefore as I live saith the Lord of hosts, the God of Israel, surely Moab shall he as Sodom and the children of Ammon as Gomorrah.

And thus throughout the Old Testament we find Lord God of Israel. If he had prophesised that a Messiah named Jesus would come to earth; the preachings of that Messiah have no relevance to those who are not children of Israel. Even the Old Testament does not tell us that Lord God of Israel was to take over as God of all mankind. And where was the Messiah horn? in Bethlehem in Palestine, not in Persia, or Egypt let alone in Italy or in India. Hie was clearly meant for the Jews only.

 

5.1.5. Other Gods

 

There are many references to other gods and Lord God of Israel spites them all and  tells his children to smite them.

 

Jermiah Chapter 43 pars, 13

 

    He shall break also the images of Beth-Shemesh that is in the land of Egypt and the houses of the gods of the Egyptians shall he burn with fire.

 

Chapter 44 para 8.

    In that ye provoke me unto wrath with works of your hands, burning incense unto Other Gods in the land of Egypt.

 

Kings II Chapter 17

para 7- For so it was that children of Israel had sinned against the Lord their God  

           and had feared other Gods.

 

para 29 Howbeit every nation made Gods of their own.......

 

para 35 With whom the LORD (i.e. Lord God of Israel) had made a covenant and

            charged them saying ye shall not fear other gods nor bow yourself to them,

            nor serve them, nor sacrifice to them.

 

Chapter 22.

 

paras 15,16,17, And she said unto them, Thus saith the lord God of Israel,

        Tell the man that sent you to me, Thus saith the LORD, behold I will bring evil   

        upon this place, and upon the inhabitants thereof.....because they have  

        forsaken me and have burned incense unto other gods.

 

Deuteronomy

 

Chapter 7 Para 25

The graven images of their gods shall ye burn with fire

 

Chapter 12 paras 1,2,3.

These are the statutes and judgements which ye shall observe to do in the land which the Lord God of thy fathers giveth thee to possess it.....

ye shall utterly destroy all the places, wherein the nations which ye shall possess

served their gods:....And ye shall overthrow their altar …. ye shall hew down the graven images of their gods; and destroy the names of them out of that place.

 

Chapter 13, paras 6,7,8

If thy brother, the son of thy mother.... entice thee secretly saying, let us go and serve other gods ... namely of the gods of the people which are round about you, nigh unto thee or far off from thee, from one end of the earth even unto the other end of the earth, thou shall not consent unto him.

 

Chapter 31 para 20.

........then will they turn unto other gods and serve them and provoke me and break my covenant.

 

Chapter 32 paral17

They sacrificed unto devils not to gods, to gods whom they know not to new gods that came newly up, whom your fathers feared not.

6. Book Reviews.

The Story of the Red Fort Trial by P.L.Inamdar, Popular Prakashan Bombay , 1979 Price 40 Rs.

 

Gandhi was killed by Nathuram Godse on 30th January 1948. Ever since the full story of the events leading to this fateful event and. subsequent trial has never been told. Government of India has consistently suppressed the truth. Inamdar's book throws some light on the subject,

 

Inamdar was a lawyer and a staunch follower of Gandhi. Dr. Parchure was a powerful Hindu Mahasabha leader of the same town, Gwalior. Unfortunately he happened to have exactly the same kind of pistol (though a licensed one) as used by Nathuram Godse. Congress party had. poignantly decided to pounce on this opportunity. Dr. Parchure was told bluntly " sign a confession to the effect that you supplied the pistol used by Nathuram otherwise we will switch the pistols and also harass your 83 year old mother." We have seen enough horrific acts during Indira Gandhi's emergency of 1977. Parchure was kept in Gwalior Fort. It was intensely cold. He was kept for 17 days in unbearable conditions and began to have intense pain in his joints. He was eventually forced to sign the confession to save his family.

 

Mrs. Parchure approached Mr Inamdar for help. He decided to take the case. He

successfully acquired the acquittal of Dr. Parchure. As the case proceeded he came across Nathuram Godse and others and. towards the end he became a thoroughly changed man. He confesses that tears rolled down his cheeks as he said good bye

to Nathuram. He says towards the end " .. court of law as well as penal code DID EXIST TO ADJUDICATE UPON Nathuram's deed. But there was no such court nor a law to adjudicate what Gandhi had done.....''

 

A compulsive reading indeed.

 

7. Some important notes relating to Gandhi Murder Trial.

 

1. There was a gun cotton slab explosion at Birla house where Gandhi used

to hold prayer meetings, on 20th January 1948. The purpose was to draw Gandhiji's attention to the plight of the refugees who were being weeded out from visitors to Birla House. The explosion would not have harmed anybody. But the Congress controlled newspapers used it as a publicity stunt just as they used Gandhiji's deceptive fast during 1942.

 

2. Gandhi was shot dead by Nathuram Godse on 30th January 1948. There was no

reason to announce his name on radio immediately. As a result there were horrific attacks on Brahmins in Maharashtra. Nehru, Patel & co. wanted this to happen.

 

3. Witnesses claim to have seen smoke coming from Nathuram's pistol. But no smoke could have come out of it.

 

4 Marks on Gandhi's body did not match with the marks that could have have been made by Nathuram's pistol. But Nathuram had decided to he a. martyr and refused to allow his attorney to cross-examine Colonel Taneja of Irvine Hospital who had recorded wounds on Gandhiji's body.

 

5. Retrospective legislation is abhorred by lawyers all over the world even in South Africa. But Nehru, Patel & co. (most of them lawyers themselves) had decided to go to any length. Bombay Public Security Act was made applicable to the province of Delhi with retrospective effect by a. Government of India decree of 2 June 1948, for the sake of the trial

 

6 Congress leaders had always detested special courts set up by the British (especially during the Second World War). But they had not slightest hesitation in setting up a special court for this trial. The provisions were nasty - There was NO JURY, time for appeal was extremely limited (15 days instead of normal 60 days) the sentence for even attempted murder was death or transportation for life.

 

7. In legal terms there is quite a difference between aiding and abating a murder and conspiracy to murder. The penalties for latter are far more severe than for former. It is also very much easier to secure conviction for conspiracy. Nehru, Patel & co. wanted to implicate Veer Savarkar, hence Patel’s official order to carry out police investigation for a conspiracy.

 

8. Though Morarji Desai (then Home Minister of Bombay) had kept Savarkar under police surveillance he did not rush police reinforcement to protect him when mob frenzy broke out against Brahmins in Maharashtrs- on 31st January 1948. Not only that his bodyguard  Appa Kasar was arrested and removed to Police custody. Morarji Desai deliberately left Savarkar at the mercy of the lynching mob. But Balarao Savarkar, Bhaskar Shinde and Tendulkar stood in the doorway armed only with sticks and ward off the attackers. But they could not save Narayanro younger brother of Veer Savarkar. He was severely beaten, never recovered and died on 19th October 1949.

 

9. Savarkar then aged 64 was bed-ridden for past 1 year. He was arrested on 5th Feb 1948 under Bombay Public Security Measure act. He was not allowed to see even his wife and only son till 23 March 1948 i.e. 46 days. What great humanitarians were the followers of Gandhi !!

10. Judgement of the special court was delivered on 10th Feb 1949. Savarkar was acquitted. But Nehru Patel & co would not tolerate any public celebrations. That was not the sort of truth they wanted. So Delhi Magistrate served an order prohibiting him from leaving the Delhi Red Fort area. A few hours later by another order under Punjab Public Security Measures act, Savarkar was externed and was prohibited from entering the Delhi area for a period of 3 months and was escorted by police straight to his house in Bombay.

 

11. Dr. Parchure favoured no better. He was acquitted by the appeal court on

21st June 1949. But immediately afterwards Nehru, Patel & co. promptly served an order of detention under the Public Safety Ordinance, at the main gate of the Ambala Central Jail. With that order Dr.Parchure was brought to Gwalior. There he was served an order of Externment from Gwalior division of the State of Madhya Bharat for six months, from the date of his acquittal.

 

12. Nathuram never denied, killing Gandhi. He also never pleaded for clemency. He simply wanted to meet his parents before going to Gallows. His last request was that as his parents were too old to travel to Simla he should be sent to Poona and hanged there. But Patel so called Iron man would not consent. So much for the humanitarism of Gandhi Followers.

 

13 Gopal Godse, the brother of Nathuram Godse tells us that at some time later

(c 1953 )   the Supreme Court of India ruled that even the special court set up for Gandhi Murder Trial, was illegal but refused to declare its verdict as null and void. He however gives no references.

 

14. Full story of the court case was never made public, under various emergency

regulations, press acts and physical reprisals, nothing was reported in the press except what Nehru, Patel & co approved. They of course had the control of Radio. As soon as Nathuram Godse read his testimony on 10th Dec 1948 its publication was banned by Patel. And the ban remained in force until 1977 (i.e. for 30 years) Congressites never wanted the truth to come out. The court case we are told was even excluded from Indian Law reports. Under the shadow of death Apte wrote an essay on Public Administration. Government of India has still banned its publication!

 

15. Press News Agency (of Government of India) had. prepared a short Documentary film on the accused. It was being shown in the cinemas; when the trial was in progress. But to utter dismay of Nehru, Patel & co, people instead denouncing Nathuram Godse and others actually praised them. They of course prohibited further showing of that documentary film.

 

16. During the trial, Patel visited Gwalior and in a public speech he said that it was a disgrace that the revolver used to kill Gandhi came from Gwalior. When the matter was sub-judice such remarks amounted to contempt of the court. Patel a barrister who studied law in England was of course aware of this. But like Gandhi, there was no law for him.

 

17. After the verdict of special court there was discussion about whether Godse and Apte should be hanged, published in various Indian Newspapers. Most of the letter to the editors expressed the opinion that the two should not be hanged. And once again Patel prohibited publication of all such letters.

 

18. There are set rules for identification of suspected persons. Such a person is normally mixed with people of similar heights, built up and appearance. The witness is then asked to identify the suspected person from among the group. The witness does not see the accused till the day of the trial. But this was flagrantly set aside in Gandhi Murder trial.

 

A visual training camp was opened in the new C.I.D. Head-quarters, at Worli Bombay. Not only were the accused kept in that building but also the articles of proof were stored in the custody of the Police in this building and not in the custody of the judicial authority. The identifying witnesses were taken in groups from Delhi, Kanpur and Gwalior and also from places all over Bomba State and kept in the same building (i.e. C.I.D. Headquarters) without the .supervision of the Judicial authority, virtually in police custody, before the witnesses were called upon to identify the accused and the exhibits

 

The accused were regularly photographed in police custody, at a stage and for reasons not permissible in the procedure for identification. The accused were filmed and photographed in the Red Fort courtroom itself on 27 May 1948 when the trial opened. The film and photographs were given the widest possible publicity all over India by the Information Department of Government, controlled by Patel, and the press controlled by the Congressites.

 

The witnesses were offered free trips to Bombay and hospitality of Bombay C.I..D. all at public expense, before being called for an Identification Parade before a Bombay  Magistrate. This was done at  leicesure weeks after the witnesses were contacted. The same Witnesses were called upon for the substantive evidence of identification before the special judge, after all the publicity and unbridled public exposure of the appearance of the accused, not only in the press and theatres but also in the Court of law through films and photographs of them on the first day of trial, and the press and newsreel publicity during the trial!

 

All this is abhorrent to due process of Law. But all English Authors keep quiet about it.

 

19. The whole case for Prosecution was based on hearsay and confessions under torture/ inducements to witnesses. But for placing explicit faith in Government witnesses the special Judge Mr Atma Charan was awarded by Nehru, Patel and co. He was appointed Judicial Commissioner for Ajmer-Merwara region even before the conclusion of trial. He sent every accused, except Savarkar, to transportation for life.

 

20. As for inducement we can quote the case of Magistrate R.B.Atal of Gwalior. He had not been given increments in pay for last 10 years by Gwalior Durbar. But after extracting confession from Dr. Parchure, he was grafted an. Increment of Rs.100 p.m. (at 1948 prices)
